Refund and Cancellation Policy

This policy is prepared in accordance with Turkish Consumer Protection Law No. 6502 and distance contracts regulations.

1. General Principles

This Refund and Cancellation Policy applies to all software development services, including custom CRM, ERP development, and API integration services ("Services") provided by Tuğrul Yıldırım ("Service Provider", "we", "us", or "our").

All refund and cancellation requests are subject to the terms specified in the individual Project Agreement and Turkish Consumer Protection Law No. 6502.

2. Right of Withdrawal for Distance Contracts

In accordance with Turkish Consumer Protection Law No. 6502, for distance contracts (contracts concluded without the simultaneous physical presence of the parties), consumers have the right to withdraw from the contract within 14 days without giving any reason.

2.1. Exceptions to the Right of Withdrawal

However, the right of withdrawal does not apply to:

  • Custom software services: Services that are custom-developed and begin immediately upon agreement, where the service cannot be returned in its original state
  • Services fully performed: Services that have been fully performed with the consumer's explicit consent before the withdrawal period expires
  • Digital content: Digital content that has been delivered and the consumer has consented to immediate performance

Important: As our services involve custom software development that begins immediately upon agreement, the standard 14-day withdrawal period typically does not apply. This will be clearly stated in each Project Agreement.

3. Cancellation by Client

3.1. Cancellation Before Work Begins

If you cancel the project before work has begun:

  • You will receive a full refund of any advance payments made
  • No cancellation fees will apply
  • Refund will be processed within 14 business days

3.2. Cancellation After Work Begins

If you cancel the project after work has begun:

  • You will be charged for all work completed up to the cancellation date, as specified in the Project Agreement
  • Any remaining balance will be refunded within 14 business days
  • Deliverables completed up to the cancellation date will be provided to you

4. Cancellation by Service Provider

We reserve the right to cancel a project in the following circumstances:

  • Non-payment: If payment is not received within the agreed timeframe after reminders
  • Material breach: If the client materially breaches the Project Agreement
  • Impossibility: If the project becomes impossible to complete due to circumstances beyond our control

In such cases:

  • You will receive a refund for any work not yet completed
  • You will be charged only for work completed up to the cancellation date
  • Refund will be processed within 14 business days

5. Refund Process

Refunds will be processed within 14 business days from the date of cancellation approval. The actual time for the refund to appear in your account may vary depending on your payment method and financial institution.

5.3. Refund Method

Refunds will be issued using the same payment method used for the original transaction, unless otherwise agreed. For bank transfers, please provide your bank account details.

6. Non-Refundable Items

The following are generally non-refundable:

  • Work that has been completed and delivered
  • Third-party services or licenses purchased on your behalf (unless transferable)
  • Consultation services that have been provided

7. Disputes and Complaints

If you are not satisfied with our refund decision, you have the right to:

  • Request a review of the decision by contacting us directly
  • File a complaint with the Turkish Consumer Arbitration Committee
  • Seek resolution through the competent courts of Turkey
